User Agreement

The clients and service users shall agree to use the website or service only for lawful purposes and in accordance with the terms of service, referred to as agreement, who shall also agree not to use the website or service in any way that violates any applicable federal, state, local, or international law or regulation. In case the website or service requires the clients and service users to register in the website or service, they shall agree that their registration information is accurate and up-to-date.

The clients and service users agree that:

  1. They accept the terms of service expressed herein and confirm that they give their consent to transfer personal information by taking all reasonable steps to ensure that adequate protection is in place before they transfer such personal information;

  1. They shall use the website or service only for lawful purposes, and at their own risk, and in accordance with the terms of service, referred to as agreement, who shall also agree not to use the website or service in any way that violates any applicable federal, state, local, or international law or regulation. In case the website or service requires the clients and service users to register in the website or service, they shall agree that their registration information is accurate and up-to-date;

  1. The company not be liable to them or any third party for any consequential or incidental damages (both of which terms include, without limitation, pure economic loss, loss of profits, loss of business, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to their use of the website, or in any way connected to, their access to, use of, inability to use, or reliance on the website or service or any material or any information obtained or accessed through website or service;

  1. They shall deal with the company and other users of the website including third party users in good faith and in compliance with all applicable laws; give their consent to the use of cookies required in connection with the use and delivery of website or service; and notify the company if they become aware of any loss or theft of any password or any unauthorized use of a username, passwords, website’s content, website or service;

  1. They shall be provided a limited, revocable, non-transferable, and non-exclusive license to access and use the website or service by displaying it on their internet browser only for the purpose of receiving website or service delivered on the web platform of the company and not for any commercial use or use on behalf of any third party, except as explicitly permitted by the company in advance;

  1. Any material, information, and/or data downloaded or otherwise obtained through the use of website or service is done entirely at their own risk and they shall be solely responsible for any damage to their computer system or loss of data that may result from the download of such material, information, and/or data;

  1. They use website or service or its content only for intended purpose and do not in any way sell, license, lease, and commercialize such content; and do not modify the materials at the website or service in any way or repost, republish, reproduce, publicly display, perform, assign, sublicense, sell or prepare derivative works of or otherwise use the materials for any purpose except as expressly permitted under this agreement;

  1. The temporary interruption of the service available through the website or service may occur as normal events and that the company has no control over third party networks they may access in the course of the use of the website or service, and therefore, delays and disruption of other network transmission are completely beyond its control; and

  1. They shall be solely responsible for any and all acts or omissions with respect to access and use of the website or service by any authorized user or unauthorized person accessing the website or service using an account created on the website or service that represents an account of an authorized client or service user, and they access only the data and/or information on the website or service that they are authorized to access under the provisions of this agreement and the clients’ and service users’ account request form, and to use the website or service solely for the permitted purpose.

Data includes web data and means information that has been translated into a form that is efficient for movement or processing, and converted into binary digital form in its most basic digital format, and includes web data. The importance of data in business computing is more apparent, which encompasses information and related technology. The company recognizes the fact that, nowadays, a distinct data profession has emerged along with growth of corporate data processing. 

Data shall also include text, audio, and visual information, as well as, log and web activity records that describes a gathered body of facts. Hence, data has meaning beyond its use in computing applications oriented towards data processing, interconnection of components, and network communication. The company has placed added emphasis on ensuring data quality by reducing duplication and enhancing accuracy and currency of data and records to capitalize on such information system and increasingly strive for real-time performance, so that its data and information system are built to handle incoming data consumed at high ingestion rates, and to process data streams for immediate use in operations.

The website or service shall come with analytics and automation, application and platform security, cloud security, compliance, data security and privacy, application programming interface management, application development and design, application management tool, architecture management (data and web), business application integration, business intelligence, database administration, descriptive statistics, backup and recovery software, cloud backup, disk backup, remote data protection, data breach detection, security frameworks and standards, and information system management through series of documented process. While its web data comes from large or diverse number of sources, which is information sourced and structured from various sites across the internet. Developed with the help of semantic web tools that allows sharing of information through HTTP protocol or SPARQL endpoint. 

Web data provides its clients and service users fast and accurate insights to make decision to help them succeed. They require web data integration platforms for automated insights, and such platforms, require a lot of data, specially web data, to perform well. Moreover, web data helps its clients and service users to gain real time insights into media intelligence, protect their brands from many online threats, create more accurate and effective risk assessment solutions; keep up with the regulatory compliance; and analyze critical real time and historical market information; create accurate predictive financial models and benchmarking solutions; and build accurate and effective models through well-structured and unified web data including open web application program interface.

The web data service of the company, which is service oriented architecture is applied to data sourced from world wide web and internet as a whole so as to enable its clients and service users to access, use and share structured data and applications in a web service environment in which applications may subscribe to and consume information, provide and publish information for others to consume, or both. Applications that can serve as a consumer-subscriber and/or provider-publisher of web data services may also include mobile computing, web portals, enterprise portals, online business software, social media, and social networks. 

Hence, it is the objective of the company to support business information sharing through web data services. Increasingly, the company shall add more web data services to integrate mashup-style user-driven information sharing into business intelligence, business process management, predictive analytics, content management, and other applications, mostly according to industry analysts.

The web data of the company shall touch every aspect of doing business with the company. It helps the clients and service to create, consume and interact while working with the company in its web platform thereby helping to extract meaningful data from the web - reliably, cost effectively and at scale, which can play a vital role in helping its clients and service users get up-to-the minute insights about their business requirement, understand the competitive landscape, optimize the service delivery and service strategies. 

Today, the intensified digital transformation is shaping new digital habits, removing social distancing along with the shift to remote working, and changing the way we socialize and consume data. With each click, swipe, share, and like, a world of data is created, and it continues to grow at an explosive pace.

As digitalization is rapidly increasing, so is the demand for data. Across every industry sector, organizations have never been more reliant on web data. Data including web data drive everything. It’s the differentiator that enables businesses to innovate and grow. The business’s speed to insight is key to mitigating losses and fostering business growth. 

The quality of data shall be a top priority of the company to provide information on a number of services offered by it with deeper and frequent interaction with data across multiple channels in the web platform and deliver its service portfolio in a practical format that the clients and service users can easily access and act on. The online proposition shall comprise of service, news, journals, articles, blogs, program data, assessment techniques, important link to useful sites and allied applications as close to real time as possible that benchmark the corporate health of its clients and services. Hence, getting a proper hold of foregoing information – quickly, reliably, cost-effectively and in a usable format is the topmost priority of the company. 

It’s no surprise that capturing reliable web data at scale and making sense of it is always tougher, costlier and more time consuming. Therefore, the in-house experts of the company shall help its clients and service user to extract automatically the web data with self-serve web interface and easy-to-use front end as a discovery tool. 

Meanwhile, the web integration of the company goes beyond traditional web scraping to provide hidden insights to its clients and service users and help them acquire and transform data from multiple websites into one cohesive workflow through data extraction, transformation, standardization, API integration, and data mapping. 

Hence, it shall be the responsibility of the clients and service users to understand data including web data and their web integration and the software component to access and extract data from the website or service. The company shall be liable to identify what type and data sources might provide its clients and service users with business insights - for example, web sources where information is located, and identify the URL where their data is located; begin the web data extraction process once it has identified and targeted specific data sources; prepare data by maintaining its quality be performing series of steps such as cleansing, normalization, and standardization and ensure that data quality is maintained throughout the remaining integration process; integrate data into application programming interface once the data has been normalized and a certain standard of data quality has been achieved; while its clients and service users shall agree to utilize data with the help of fully integrated data to discover powerful insights from the data processed by the company, for example, its clients and service users can now integrate this data for machine learning and other AI business processes.

Integrated service shall mean service or group of services or sub-services that make a service wholly and fully deliverable under a contract or agreement underlying a service portfolio (e.g. there are services like corporate governance service, commercial governance service, process control governance service, industrial governance service, IT governance service, and not-for-profit governance service under governance service portfolio).

The registration, renewal, and extension of accounts, website or service shall be in accordance with the terms of service and the renewal and extension shall be carried out only after a valid contract is undertaken between the company and its clients and service users to these effects. The suspension of accounts, website or service shall be in accordance with the terms of service expressed herein.

Donors or donor agency(ies) take action when the humanitarian system does not perform well. Under, CPAA agreement, the recipients or prospective partner organization shall have to commit to meet minimum standards in their internal procedures and programming before they can apply for funding, when it comes to Core Inclusion Nepal Program (CINP). The company shall apply tools to examine that the partners adhere to standards and accountability mechanisms at the various stages of the funding cycle, extend cooperation during proposal appraisal, monitoring, financial and narrative reporting and evaluation – all carried out in an extensive platform, namely, Core Inclusion Nepal Program Multiple Donor Platform (CMDP). 

When appraising proposals, the screening shall require and include that the tools used for needs assessment and project planning are appropriate; a transparent and cost-effective budget is provided; arrangements are made for qualitative monitoring and independent evaluation; and there is a commitment to applying agreed standards. The monitoring staffs shall be responsible to monitor the project, who also ensure that the standards set at the proposal stage are met, and offer technical assistance to support other elements of good quality management, for example recommendations on improving monitoring systems through better quality indicators and help with designing an after-action evaluation. 

As a best practice, the company is responsible to share monitoring reports amongst donors across CINP Multiple Donor Platform (CMDP) and to organize joint donor visits, which in turn helps reduce the burden on partner agencies. The screening and assessment shall be undertaken first hand, including fund and program level activity due diligence (FPLA-DD), as a means to add value, which goes far beyond the usual sharing of information on activities in coordination meetings. 

In this way, a monitoring visit shall become a true source of joint learning and collective quality improvement. A CPAA agreement is agreement that applies checklists-based approach to assess the eligibility of prospective partner entities for CINP funding. The checklist has a universal application, and shall be applied by donors that reside in CMDP.

Reporting, especially financial reporting, is a standard mechanism for enforcing accountability as a lack of information or analysis or doubts about the same can lead to an external audit and potential legal consequences, including agencies requesting the reimbursement of funds or asking the monitoring by fraud investigation unit to take formal action. As a result, partners themselves normally ensure that good-quality reports are submitted on time. The agencies shall also use external evaluations, namely, donor led external evaluation, commissioned either by donor itself or by monitoring partners, which can be eye-openers, both for the implementing partner and for the donor, and can lead to institutional learning on both sides.

The CMDP shall have qualified and experienced field staffs, who shall provide supportive supervision to its partners. They shall be involved for many years in the implementation of CINP. They are highly credible staffs with time and resources to visit funded projects regularly and strengthen significantly the donor’s ability to reinforce quality and accountability. An exclusive focus on maintaining adequate donor administration costs (including resources for monitoring) is sure to affect quality and impact of CINP. 

Hence, the effectiveness of all of the quality control mechanisms with the exception of financial reporting requirements shall depend almost entirely on the goodwill and internal procedures of partners. The core focus shall be on proper accountability framework of the leadership for humanitarian reforms by emphasizing on mutual responsibility to share information to improve the international humanitarian response system. 

The annual CINP Action Plan (ACAP) shall be basic to improve joint reporting on common indicators in order to get an overview of what the CINP and its stakeholders have collectively achieved with Core Model Program Development Funding (CMPDF) through which CMDP can call for increased collective accountability and better results and to further harmonize CINP standards and approaches in order to use their leverage to more effect.

Whilst CMDP shall focus on meeting beneficiaries needs at the lowest possible cost (i.e. being efficient), it shall have an obligation to ensure they achieve the highest possible impact with the funding they have available (i.e. being effective) and assess and systematize the documentation, requirement, and CINP management tools by identifying industry specific elements of interest such as sustainable development goals that need to be incorporated into CINP management. This means not only selecting the best projects but also ensuring that proposals address areas and populations with the greatest needs. Funding second or third priority operations can reduce effectiveness as resources are then not available for more severely affected people. Hence, CMDP shall use all means available to them to ensure that they have sufficient data and information to make informed decisions on where and how to allocate funds. 

Finally, CMDP shall be accountable to itself, through self-regulation, and to external actors, including non-operational agencies, host governments, taxpayers and the media from developing response index to managing CINP Risk Register (CRR) to policymaking on how their efforts are seen from the ground. The CMDP shall develop initiatives, implement and adopt set of standards and operational principles. It shall have systems in place that reward high-impact operations, punish low quality and link impact measurement of a funded operation to determine how well the CMDP staffs in charge of that CMPDF performed oversight during implementation. 

There is, however, an attribution problem as high-impact operations depend on many factors beyond the control of the CMDP and its staff. Most of the performance frameworks shall focus on the quality of partners’ work. The CMDP shall prepare reports to increasingly focus on what went wrong rather than what worked well that leads to highly visible actions that mostly achieve the greatest impact.

The CMDP shall push for better accountability within the CINP system as a whole by putting quality at the core of its work, which includes the performance of all stakeholders. It shall take efforts to find ways to use its leverage wisely and responsibly and use its collective potential to press for more rapid change and better performance. While it shall listen the partners before allocating CMPDF, allowing them as much operational independence as possible, it shall also exercise as much quality control as necessary to ensure the most effective use of CMPDF for those in greatest need of development aid.
